The e-commerce website of Sir Walter is part of Fritz & Hammy’s, a sole proprietorship with registered office at Paul Snoekstraat 3, 8490 Varsenare, Belgium, VAT BE0752845605 (hereinafter "Sir Walter, part of Fritz & Hammy’s") and offers its customers the possibility to purchase products from its online store.
These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website ("Customer"). By placing an order through Sir Walter’s online store, the Customer must explicitly accept these Terms, thereby agreeing to their applicability, to the exclusion of all other conditions. Any additional terms of the Customer are excluded, unless expressly, in writing and in advance accepted by Sir Walter (part of Fritz & Hammy’s).
Article 2: Price
All prices stated are in EURO, always inclusive of VAT and all other duties or taxes to be borne by the Customer.

Article 3: Offer
Despite the fact that the online catalog and e-commerce website are composed with the greatest possible care, the information provided may still be incomplete, contain material errors, or not be up to date. Obvious errors or mistakes in the offer do not bind Sir Walter (part of Fritz & Hammy’s). Regarding the accuracy and completeness of the information offered, Sir Walter (part of Fritz & Hammy’s) is only bound to a best-efforts obligation. Sir Walter (part of Fritz & Hammy’s) shall in no event be liable in the event of manifest material errors, typographical or printing errors.

The offer is valid while supplies last and may be modified or withdrawn at any time by Sir Walter (part of Fritz & Hammy’s). Sir Walter (part of Fritz & Hammy’s) cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be expressly stated in the offer.

Production time
All products are handmade by Sir Walter (part of Fritz & Hammy’s), so please allow approximately 1.5 weeks before your order is ready to ship. For express shipments, please contact us.
Shipping time
Shipping times depend on the destination and the chosen courier. For deliveries in Belgium, you can expect a standard delivery time of approximately 2-4 days. If you need express shipping or want information for other countries, contact us via [email protected].
Delivery methods
Depending on the destination, we ship via Bpost, PostNL or DPD. Shipping costs are communicated to the customer before final confirmation of the order. Please note: the customer is responsible for any import taxes that may apply.
Unless otherwise agreed or expressly stated, the goods will be delivered to the Customer’s residence within 30 days of order confirmation.
Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be reported by the Customer without delay to Sir Walter (part of Fritz & Hammy’s).
The risk of loss or damage transfers to the Customer once they (or a third party designated by them, who is not the carrier) physically take possession of the goods. However, the risk passes to the Customer upon delivery to the carrier if the carrier was commissioned by the Customer and this choice was not offered by Sir Walter (part of Fritz & Hammy’s).
Article 6: Retention of title
The delivered items remain the exclusive property of Sir Walter (part of Fritz & Hammy’s) until full payment has been made by the Customer.
The Customer undertakes, if necessary, to inform third parties of Sir Walter’s retention of title, for example to anyone who might seize items that have not yet been fully paid for.
Article 7: Right of withdrawal
This article only applies to Customers who purchase items online from Sir Walter (part of Fritz & Hammy’s) in their capacity as consumers.
The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving any reason.
The withdrawal period expires 14 calendar days from the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the goods.
Or for contracts where the Customer has ordered multiple goods in the same order which are delivered separately: The day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last good.
Or for contracts relating to the delivery of goods in multiple shipments or parts: The day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last shipment or the last part.
To exercise the right of withdrawal, the Customer must notify Sir Walter (part of Fritz & Hammy’s), with registered office at Paul Snoekstraat 3, 8490 Varsenare, Belgium, [email protected], of their decision to withdraw from the contract by means of an unequivocal statement (e.g. in writing by post or email). Sir Walter will provide a return form by email so that the Customer can return the order.
To meet the withdrawal deadline, the Customer must send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return the goods without delay and in any case no later than 14 calendar days from the day on which they notified Sir Walter of their decision to withdraw from the contract, to [Sir Walter, Paul Snoekstraat 3, 8490 Varsenare, Belgium]. The Customer is on time if they send back the goods before the 14 calendar days have expired.
As we are a small local business, we are unable to offer free returns. The direct cost of returning the goods shall be borne by the Customer.
The Customer is requested to return the items in their original condition and packaging, including all accessories and instructions provided. If the returned product is diminished in value due to handling beyond what was necessary to establish the nature, characteristics and functioning of the goods, Sir Walter (part of Fritz & Hammy’s) reserves the right to hold the Customer liable and claim compensation.
All returned items will be thoroughly inspected. The basic principle is that the consumer may only handle and inspect the item as they would be allowed to do in a store. Returned items may be tried on, but not used. If an item has depreciated due to use by the Customer, this will be charged to the Customer.
If the Customer withdraws from the contract, Sir Walter will refund all payments received for the products/goods to the Customer no later than 14 calendar days after being informed of the Customer’s decision. In sales contracts, Sir Walter may withhold reimbursement until it has received the goods back or until the Customer has supplied evidence of having sent back the goods, whichever is the earliest.
Any additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard delivery offered will not be refunded.
Sir Walter will refund the Customer using the same payment method as used in the original transaction, unless the Customer has expressly agreed otherwise; in any case, no fees will be charged for such reimbursement.
The Customer cannot exercise the right of withdrawal for:

the supply of goods made to the Customer’s specifications or clearly personalised;

the supply of goods which are liable to deteriorate or expire rapidly;
-
the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
-
the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.
Article 8: Warranty
Pursuant to the Act of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has statutory rights. These statutory rights apply from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer’s home, the Customer must contact Sir Walter (part of Fritz & Hammy’s) customer service and return the item at their own expense.
In the event a defect is discovered, the Customer must inform Sir Walter (part of Fritz & Hammy’s) as soon as possible. In any event, any defect must be reported within a period of 2 months from its discovery. After that, all rights to repair or replacement expire.
The (commercial and/or statutory) warranty never applies to defects arising from accidents, neglect, falls, abnormal or incorrect use, failure to comply with the user instructions or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.
Defects manifesting more than 6 months after the date of purchase, if applicable delivery, are presumed not to be hidden defects, unless the Customer proves otherwise.

Article 10: Penalties for non-payment
Without prejudice to other rights held by Sir Walter (part of Fritz & Hammy’s), in the event of non-payment or late payment, the Customer shall automatically and without notice owe interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer shall automatically and without notice owe fixed compensation of 10% on the amount concerned, with a minimum of €25 per invoice.
Without prejudice to the foregoing, Sir Walter (part of Fritz & Hammy’s) reserves the right to reclaim unpaid goods.
Article 11: Privacy
The data controller, Sir Walter (part of Fritz & Hammy’s), respects the Belgian law of December 8, 1992 on the protection of privacy with regard to the processing of personal data.
The personal data you provide will only be used for the following purposes: fulfilling the concluded agreement, processing the order, sending newsletters, and advertising or marketing purposes.

The Customer accepts that electronic communications and backups may serve as evidence.
